Terms of Use

In this Terms of Use ("TOU"), we, Appfluent, Inc. and our affiliates in the Appfluent group of companies (together, "Appfluent"), set forth the terms by which you may use our services. "Services" refers collectively to: (a) our websites, including www.appfluent.us and xwidget.dev; (b) the XWidget software development kit ("XWidget SDK"), including associated packages, libraries, and command-line tools; (c) the XWidget Cloud platform, including server-driven UI delivery, analytics, and related APIs ("XWidget Cloud"); and (d) any other websites, applications, tools, or services that we operate and on which we post a direct link to this statement. By using any of the Services, you are agreeing to these TOU. If you do not agree to these TOU, you may not and should not use the Services.

Copyright Notice and Use of the Services

The contents of the Services are protected by the copyright and other laws of the United States, its treaty countries and other jurisdictions. Except as may otherwise be provided in a written agreement you have with Appfluent or as expressly permitted by an applicable open source license, you may not modify, copy, reproduce, republish, upload, post, transmit, transfer, or distribute in any way any of the contents of the Services. You may download content from the Services solely for your personal, non-commercial use (except as may otherwise be provided in a written agreement you have with Appfluent or as permitted by an applicable open source license), provided you keep intact all copyright and other proprietary notices. Any copies of the content must include Appfluent's copyright notice: © Copyright 2026 Appfluent, Inc. Nothing in these materials is an offer to sell any of the products and/or services referenced herein.

Open Source Software

Certain components of the Services, including the XWidget SDK, may be made available under open source licenses. Your use of such components is governed by the applicable open source license terms, which are provided with the software. In the event of a conflict between these TOU and an applicable open source license, the open source license shall govern solely with respect to the component covered by that license.

XWidget Cloud Services

XWidget Cloud is a platform that provides server-driven UI delivery, analytics, and related services to registered users ("Customers"). By using XWidget Cloud, you agree to the following additional terms:

Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials, project keys, and delivery tokens. You are responsible for all activities that occur under your account. You agree to notify Appfluent immediately of any unauthorized use of your account or any other breach of security.

Acceptable Use. You agree not to use the Services to: (a) transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) interfere with or disrupt the Services or servers or networks connected to the Services; (c) attempt to gain unauthorized access to the Services, other accounts, or computer systems or networks connected to the Services; (d) use the Services to send unsolicited communications; (e) exceed any applicable rate limits or usage quotas; or (f) use the Services in any manner that could damage, disable, overburden, or impair the Services.

Customer Data. You retain all rights, title, and interest in any data, content, or materials that you submit to or through the Services ("Customer Data"). You grant Appfluent a limited, non-exclusive license to use, process, and store Customer Data solely as necessary to provide and improve the Services. Appfluent will not sell Customer Data to third parties.

End User Data. If you use the XWidget SDK or XWidget Cloud to collect data from end users of your applications, you are solely responsible for ensuring that such collection complies with all applicable laws and regulations, including but not limited to data protection and privacy laws. You must provide appropriate notice to, and obtain any necessary consent from, your end users regarding the collection, use, and processing of their data. Appfluent processes end user data on your behalf as a data processor and will not independently use such data except as necessary to provide the Services.

Service Availability. Appfluent will use commercially reasonable efforts to make XWidget Cloud available. However, the Services may be subject to scheduled or unscheduled downtime for maintenance, updates, or other reasons. Appfluent does not guarantee any specific level of availability or uptime.

Usage Limits and Rate Limiting. The Services may be subject to usage limits, rate limits, and storage quotas depending on your subscription tier. Appfluent reserves the right to throttle or suspend access to the Services if usage exceeds applicable limits or if Appfluent reasonably determines that usage threatens the stability or availability of the Services for other users.

Suspension and Termination. Appfluent may suspend or terminate your access to XWidget Cloud at any time if you breach these TOU, engage in abusive or fraudulent activity, or if continued use would pose a security risk to the Services or other users. Where practicable, Appfluent will provide notice prior to suspension or termination. Upon termination, your right to access the Services will cease. Appfluent may retain or delete Customer Data in accordance with its data retention policies.

Analytics Data

XWidget Cloud may collect analytics data, including but not limited to render events, navigation events, platform information, version information, locale, and country code. This data is collected to provide analytics dashboards and insights to Customers. Appfluent may use aggregated and anonymized analytics data to improve the Services. For more information about how analytics data is collected and used, please refer to our Privacy Policy.

Links

The Services may contain links to third party websites which are controlled and operated by third parties. Your use of each third party website is subject to the terms of use and other guidelines, if any, contained within the relevant website. You agree to review and accept such terms of use prior to using such third party websites. Appfluent makes no representations whatsoever about any third party website which you may access through the Services. When you access a third party website, you agree that it is independent of Appfluent, and that Appfluent has no control over any content on that website. In addition, a link to a third party website does not mean that Appfluent accepts any responsibility for the content, or the use, of such website. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, worms, trojans and other items of a destructive nature.

Privacy

In order to operate and provide the Services, we collect certain information about you. Our practices with respect to the information we collect are described in our privacy policy which is available at www.appfluent.us/privacy-policy ("Privacy Policy"). By agreeing to these TOU you are agreeing to our Privacy Policy. Information, including but not limited to personal information, collected through the Services may be stored and processed in the United States or any other country in which Appfluent or its affiliates, subsidiaries or agents maintain facilities. By using the Services, you consent to any such transfer of information outside of your country.

Disclaimer

The materials and Services are provided "as is" and without warranties of any kind either express or implied. Commentary and other materials posted on or through the Services are not intended to amount to advice on which reliance should be placed, and we therefore disclaim all liability and responsibility arising from any such reliance. To the fullest extent permissible pursuant to applicable law, Appfluent disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, title and non-infringement and any other conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity. Appfluent does not warrant that the Services or functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that the Services, or the servers that make them available, are free of viruses or other harmful components. Appfluent does not warrant or make any representations regarding the use or the results of the use of the materials or Services in terms of correctness, accuracy, timeliness, reliability, or otherwise. You (and not Appfluent or its licensors) assume the entire cost of all necessary maintenance, repair, or correction.

Limitation of Liability

Under no circumstances, including, but not limited to, negligence, shall Appfluent, its subsidiaries and affiliates be liable for any direct, indirect, incidental, special or consequential damages that arise or result from or are related to the use of, or the inability to use, the Services or any content made available on or through the Services. This includes, without limitation, damages for loss of data, loss of profits, business interruption, or any other commercial damages or losses. You specifically acknowledge and agree that Appfluent, its subsidiaries and affiliates are not liable for any defamatory, offensive or illegal conduct of any user of the Services. If you are dissatisfied with the Services or any materials made available by or through the Services, or with these TOU, your sole and exclusive remedy is to discontinue using the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Appfluent, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these TOU; (c) your violation of any rights of another party, including any end users of your applications; or (d) any claim that your use of the Services caused damage to a third party.

Export Restrictions

You must comply with all domestic and international export laws and regulations that may apply to the software or other materials obtained through the Services.

Modification & Termination

These TOU are effective until modified or terminated by Appfluent. Appfluent may modify these TOU from time to time and the new TOU will be effective when posted. If Appfluent makes material changes to these TOU, we will make reasonable efforts to notify you, such as by posting a notice on the Services or sending an email to the address associated with your account. Your continued use of the Services after any such changes constitutes your acceptance of the new TOU. Appfluent may also terminate these TOU at any time without notice to you. In the event of termination, you are no longer authorized to access the Services and the restrictions imposed on you with respect to material obtained from the Services, the disclaimers and limitations of liabilities, the indemnification obligations, and export restrictions set forth in this agreement, shall survive.

General

These TOU shall be governed by and construed in accordance with the laws of the State of Maryland without giving effect to any principles or conflicts of law. If any provision of these TOU shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. These TOU constitute the entire agreement between you and Appfluent regarding your use of the Services, superseding any prior agreements between you and Appfluent relating to the same subject matter.
